Growing/Cultivating Marijuana

It is illegal to grow or cultivate marijuana in the state of California. According to California Health and Safety Code Section 11358, "Every person who plants, cultivates, harvests, dries or processes any marijuana or any part thereof shall be punished by imprisonment in the state prison.”  This is a felony offense that carries potentially severe penalties for anyone who is convicted under this statute.

The drug crimes defense attorneys at WILL & WILL, LLP have defended many clients accused under the aforementioned statute.  Our attorneys know what the prosecution has to prove in order to convict someone of growing/cultivating marijuana.  The California criminal jury instructions give the following guidance: In order to be found guilty of this crime, the prosecution must prove each of the following elements: (1) A person planted a marijuana plant; and (2) That person knew it was a marijuana plant.  This may not always be as easy as it seems and as a result, WILL & WILL, LLP has successfully defended against many cultivation cases and kept our clients out of prison.

If you have been charged with the harvesting/growing/cultivation of marijuana, you need an experienced and knowledgeable marijuana crimes defense attorney to help you.  Call or fill out our contact form now and a drug crimes defense attorney from WILL & WILL, LLP will discuss your case and your options with you.
